Interest in the retrieval of organs from non-heart-beating cadaver donors has been rekindled by the success of transplantation of solid organs and the insufficient supply of donor organs currently obtained from heart-beating cadaver donors. There are currently two retrieval techniques being evaluated, the in situ cold perfusion approach and the controlled death approach. Both, however, raise ethical concerns. Reanimation is a new method which has been used successfully in animals. We believe this new approach overcomes the ethical objections raised to (...) these other methods. (shrink)

Thinking in Translation posits the Hebrew Bible as the fulcrum of the thought of Franz Rosenzweig (1886-1929), underpinning a unique synthesis between systematic thinking and biblical interpretation. Addressing a lacuna in Rosenzweig scholarship, the book offers a critical evaluation of his engagement with the Bible through a comparative study of The Star of Redemption and his Bible translation with Martin Buber. The book opens with Rosenzweig's rejection of German Idealism and fascination with the sources of Judaism. It then analyzes the (...) unique hermeneutic approach he developed to philosophy and scripture as a symbiosis of critique and cross-fertilization, facilitated by translation. An analysis of the Star exposes Rosenzweig's employment of translation in grafting biblical verses unto the philosophical discussion. It is followed by a reading that demonstrates how his Bible translation reflects an attempt to re-valorize the Tanakh as a distinctively Jewish scripture, over and against Christian appropriations. Thinking in Translation recasts Rosenzweig's life's work as a project of melding Judaism and modernity in an attempt to secure their spiritual and intellectual survival. (shrink)

Summary Heidegger’s jeremiads against metaphysics are amongst the most influential and iconoclastic in the annals of continental philosophy; and none is more trenchant than the Destruktion of Descartes’ ontology of self with which Sein und Zeit begins. Yet for all the intellectual energy he expends on attempting to uncover the social texture of Dasein’s being-in-the-world, many remain convinced that Heidegger simply transposes the Cartesian ego into a phenomenological key. One of the first thinkers to arouse these suspicions was an erstwhile (...) colleague of Heidegger, the Jewish-born phenomenologist and Carmelite spiritual writer, Edith Stein, in an unjustly neglected work, Martin Heideggers Existentialphilosophie. What sets Stein’s critique apart from more influential treatments is that in the course of diagnosing weaknesses in Heidegger’s account from within his own methodological constraints, she reaches some strikingly theological conclusions. The task of the present study is to offer an assessment of her dissection of the status and function of sociality in the Daseinsanalytik. After setting out Stein’s early phenomenology of empathy, I examine Stein’s argument that Heidegger’s tacit and mistaken appeal to theological categories ironically collapses his account of sociality back into the very subjectivism his Destruktion had been directed against. I conclude that Stein deftly reverses Heidegger’s strategy of atheological expropriation strategies by taking up a central theme in his own thought to articulate the theological unity of all finite existents. For Stein, unity at the level of fundamental ontology is most plausibly analysed by reference to the creaturely participation in the plenitude of Trinitarian being. (shrink)

The chorion genes of Drosophila are amplified in response to developmental signals in the follicle cells of the ovary prior to their transcription. Their expression is regulated both temporally and spatially within this tissue. They thus serve as models both for the regulation of DNA replication and of developmental transcription. The regulatory elements for DNA amplification have been delineated. Their analysis reveals that amplification is mediated by several regulatory regions and initiates at defined origins within the chorion cluster. Proteins involved (...) in amplification are being identified both by mutations affecting amplification and by DNA binding studies. Regulatory elements for temporal as well as spatial control of chorion gene, expression have been characterized, and two candidate transcription factor genes have been cloned. (shrink)

A physician’s long-established right to refuse to provide a requested service based on his or her moral beliefs is being challenged. Some authors suggest that physicians should not be licensed if they are unwilling to provide all legal services. Others would grant them the right to refuse, but require them to refer to a willing professional. What are the limits of a physician’s right to refuse? When such a right is claimed on moral grounds, what residual obligations does the physician (...) have to the patient? How should the profession (or society) decide when a moral claim to a right to refuse is justified? (shrink)

The conventional approach to developing disease‐modifying treatments for neurodegenerative conditions has been to identify drivers of pathology and inhibit such pathways. Here we discuss the possibility that the efficacy of such approaches may be increasingly attenuated as disease progresses. This is based on experiments using mouse models of spinocerebellar ataxia type 1 and Huntington's disease (HD), where expression of the dominantly acting mutations could be switched off, as well as studies in human HD, which suggest that the primary genetic driver (...) of age‐of‐onset of disease is a much weaker determinant of disease progression in affected individuals. The idea that one may approach a point in the disease course where such rational therapeutic strategies based on targets which determine onset of disease have minimal efficacy, suggests that one needs to consider other approaches to therapies and clinical trial design, including initiation of therapies in presymptomatic individuals. In about 700, a century after his death, the Life of Columba was written by Adomnán, ninth abbot of Iona. It has long been valued as the major primary source on the subject, for the light it throws on (...) early medieval Scotland and Ireland, and as an important work of literature. The 1961 edition of the Life, by Alan and Marjorie Anderson, has long been unavailable. Marjorie Anderson has now revised both the Latin text and the English translation, provided new historical notes, and rewritten the Introduction to take account of recent work in the area. This new edition of a source indispensable for the study of the early medieval church meets a major scholarly need. (shrink)

John Rawls famously distinguishes between ideal and nonideal theory, according priority to the former. He depicts his own efforts to articulate the conception of justice as fairness as an instance of ideal theory. Subsequent political theorists have taken Rawls’s distinction as a template for how we should understand the tasks of political theory. Yet they also have struggled to clarify the underlying distinction with notable lack of success. We argue that Rawls himself does not abide by the distinction between ideal (...) and nonideal theory and that this affords a good reason to set the distinction aside as a distraction. (shrink)

Requests by patients or their families for treatment which the patient's physician considers to be "inappropriate" are becoming more frequent than refusals of treatment which the physician considers appropriate. Such requests are often based on the patient's religious beliefs about the attributes of God (sovereignty, omnipotence), the attributes of persons (sanctity of life), or the individual's personal relationship with God (communication, commands, etc). We present four such cases and discuss some of the basic religious tenets of the three Abrahamic faith (...) traditions as they relate to such requests. We suggest that religious reasons for requesting "inappropriate" treatment are "special" and deserve serious consideration. We offer guidance to assist clinicians and clinical ethicists as they attempt to resolve these conflicts, emphasising the importance of understanding the religious beliefs of the patient/surrogate and suggesting the assistance of a religious interpreter. We suggest open discussion with patients and families of both the clinical situation and the theological basis for these requests. We also suggest that clinicians use additional religious doctrines or principles from patients' own traditions to balance the reasons behind the requests. We conclude that most persistent requests for "inappropriate" treatment should be honoured. (shrink)

Cost-effectiveness analysis suggests that a society should allocate its health care budget in order to achieve the greatest total health for its budget. However, in ‘rescue’ cases, where an individual’s life is in immediate peril, reasoning in terms of cost-effectiveness can appear inhumane. Hence considerations of cost-effectiveness and of rescue appear to be in tension. However, by attending to the division of labour in medical decision making it is possible to see how cost-effectiveness analysis and rescue-style reasoning are commonly combined (...) in an ethically acceptable fashion. SummarySince first appearance, reviews and accounts of The Fresh-Water Fishes of Great Britain (1828–1838) have been surprisingly few. All agree that this rare work is remarkable for its illustrations. Its importance as a whole in the history of ichthyology, however, is largely unknown, or ignored. This article therefore constitutes the first study of the textual and contextual significance of The Fresh-Water Fishes of Great Britain. By examining in chronological order where, and by whom, the work was first reviewed and referenced (...) until the 1860s, the extraordinary contributions that its author, Sarah Bowdich, made to ichthyology at the forefront of the field in the late 1820s can better be appreciated. Indeed, this multiple evidence demonstrates Sarah Bowdich's merits as an ichthyologist of the first order, and as the first woman ichthyologist. But establishing the significance of The Fresh-Water Fishes of Great Britain for the history of ichthyology then raises a further question. Why has it and its author been so ignored or forgotten? By returning for answers to the fields of ichthyology already considered, the article proposes that Sarah Bowdich's different angles on fish offer lines of investigation that are still important for the field today. A long history of extractive industries and activities have shaped the societies of northern Mozambique, and the Cabo Delgado province in particular. For centuries, the growing international demand on local resources had a great impact on the northern micro-societies. The demand for cheap labour and natural resources, ranging from ivory and cotton, to timber, rubies, land, gas and more, involved thousands of local actors in its extraction, reproducing systems of local power. The persistence of poverty, inequality and conflicts, as well (...) as simmering and sometimes grand-scale violence, fits into a long-term trend of extractivism. Through a historical approach and field observations, we focus on the political economy of extracting natural resources. We point out the persisting basic patterns of extractivism that accompanied Mozambique's integration into global markets, and continued or even deepened, in the post-independence period. These activities are oriented towards foreign markets. They are instigated by foreign investment, but invariably carried out in collaboration with a chain of national gatekeepers. In a clientelist system, local elites resort to their proximity to the state to reproduce their power, often at the expense of state expropriation. Weak state institutions have the functional effect of reproducing the elites, also serving the interests of extractivist capital. It is, however, a system with many and profound contradictions, producing conflict and violence, which also recurrently put those interests at risk. (shrink)

This article reconsiders the important work of Leroi-Gourhan through the lens of Christopher Johnson's ‘Leroi-Gourhan and the Limits of the Human’ by returning to the context of French prehistory of the 1860s that lies behind Leroi-Gourhan's discoveries and interpretations of hominid remains and artefacts in the Grotte du Renne. The Exposition universelle of 1867 and French publications of the period capture the importance of ‘préhistoire’ for Second Empire France materialized in Napoleon III's establishment at Saint-Germain-en-Laye of the first national Musée (...) des Antiquités Nationales dedicated to their collections. The archaeological discoveries, and the debates they inspired, did not escape the encyclopaedic bricolage and designs of Flaubert. With delicious clins d'oeil to the question of ‘l'homme fossile’ and ‘l'homme futur’ that he had already debated with Louis Bouilhet, this article uncovers how Flaubert's Légende de Saint Julien details the ‘limits of the human’ in Johnson's reading of Leroi-Gourhan. By returning to ‘real’ counterparts for the legendary Stag in Flaubert's tale, its contextual, allegedly fantastical, ‘préhistoires’ can better be excavated. To find the non-legendary, extreme contemporary, sources for Flaubert's disturbing text crucially informs a critique of the dehistoricization of seeing in post-war French cultural studies and sciences of the human. In response to the many changes currently going on in health care, this book offers the combined insight and wisdom of a stellar group of scholars and professionals with extensive experience in the health care field. The book opens with a look at people's actual experience of health care today, from four different perspectives. It then addresses foundational questions, including the nature of medicine, nursing, and justice. Surveyed next are the changing economics of health care as well as the impact (...) of these changes on such areas as mental health care, long-term care, health care for minorities, and legal malpractice. The closing section of the book assesses from a Christian perspective available constructive alternatives, including creative funding strategies with special attention to the needs of poor persons, physician unions, and the use of "alternative medicine" therapies. It seems intuitive to the believer that God intended through instruction in the Law to define morality, intended to lead humankind to “the right and the good.” Further, God's love for humankind, exemplified by the incarnation, atonement and teachings of Jesus, and empowered by the Holy Spirit, should lead to a better world. Indeed, the Christian worldview is a coherent and valid way to look at bioethical issues in public policy and at the bedside. Yet, as this paper explores, in (...) a pluralistic society such as the United States, it is neither possible nor desirable for Christians to try to force their views on others. Still, it is obligatory for Christians to stand up and articulate their views in the public square. We should try to persuade others using either prudential or moral arguments. While we must be willing to live with “the will of the people,” at the same time, we must not be intimidated into accepting the position that our voice is not valid because it has a religious basis. This article examines the process of one institution’s efforts to develop an educational academic integrity seminar through an ethnographic study approach. The educational program developed allowed the institution to transition from a punitive sanctioning system to an educational one. The institution cultivated cross-campus partnerships to develop the program. Both quantitative and qualitative data revealed that students had a positive experience attending the program and found it useful. This article serves as a framework for institutions to utilize when building their own (...) educational-based academic integrity on-campus seminar and sanctioning program. (shrink)

This paper presents an ethnographic study of The Black Church Food Security Network. The Network is a collective of churches, growers, and farmer’s markets creating an alternative church-to-table food distribution system. The Network is motivated by the radical imagination, a hope that defines liberation as Black communities reconnected to land. This study encourages scholars to reclaim the radical imagination of land-centered resistance movements like the Black Church Food Security Network. By doing so, ethicists are empowered to generate revolutionary social imaginaries (...) that refuse the violences of racial capitalism and colonial imaginations. (shrink)

This paper explores some aspects of the concept 'logic' and its relation to moral voice, and argues that Menssen uses it too narrowly in her respone to Orr's "Just the Facts. Ma'am" and the work of Carol Gilligan. Grounded in the work of the later Wittgenstein, it is argued that formalized logic misses much of natural logic: the concept of 'moral talk' is developed to theorize Gilligan's ethic of care; it is argued that this form of moral deliberation is not (...) argumentation in the formal sense; and the relationship between logic and epistemology is explored through the consideration of moral talk as a language-game which is woven into gendered forms of life. Finally, it is argued that the notion of a universal logic is the product of an oppressivc patriarchal culture and should not be defended by feminists. (shrink)

This article examines one institution’s transition from a legalistic approach for resolving cases of academic misconduct to a learning-centered approach that embraces peer-to-peer student-led meetings. The article provides detailed information on how to train students on conducting these meetings along with suggestions for future research. The results of this article provide a framework for institutions who wish to engage students in a learning-centered adjudication model for resolving cases.

Historians of science have long considered the very idea of a law-governed universe to be the relic of a bygone intellectual culture that took it largely for granted that a divine lawmaker existed. Similarly, many philosophers of science today insist that the notion of a law of nature is fraught with implausibly theological assumptions, preferring instead to treat them as theoretical axioms in an optimal description of nature's regularities, or else as robust patterns of causal connections or causal powers whose (...) status can be reconciled to the stringent demands of metaphysical naturalism. Yet the metaphor of lawhood has proven more difficult to dislodge than the theistic commitments it once presupposed, not least because it preserves the widespread intuition that the task of scientific inquiry is not to stipulate the difference between a lawful and an accidental regularity in nature, but to discover it. Taking its cue from the repeated failure to find naturalistic alternatives to divine lawmaking, this book undertakes a retrieval and reappraisal of a high-scholastic philosophy of nature that grounds lawlike regularities in the conceptual and causal powers of God and, having done so, concludes that the metaphysical framework of classical theism yields a more powerful and parsimonious explanation of the rhythms and patterns of the natural world than its secular rivals. This paper predicts the probability of a profound world climate change that will affect the governance of the world's societies. Carbon dioxide levels in the earth's atmosphere may be doubled in sixty years, warming the earth's climate and altering drastically the patterns of food production, agriculture, forestry and consequently relations between societies.

Historically, crises have spawned deliberate, widespread efforts to change a culture's worldviews. Anthropologists have characterized such efforts as “revitalization movements” and speculated that many of the world's religions, including Christianity, arose through revitalization. Some responses to the planet's environmental crisis share the characteristics of both a revitalization movement and an incipient religion. They call for a science‐based cosmology and an encompassing reverence for nature, and thus differ from responses to environmental decline offered by traditional religions. As environmental problems deepen, historical (...) precedent suggests that religious shifts in affected cultures may follow. (shrink)

This essay is a return to the scene of a crime. In my recent book on Hitchcock I made an outrageously general argument for the affinity between Hitch’s narrativesand David Hume’s reasoning about human nature. For something so speculative, youexpect cracks to appear pretty soon. But my impulse since the book’s appearance has notbeen to feel I exaggerated – which I’m sure I did – but to sense that I did not go far enough.There was more to be said about (...) this oblique, long distance liaison down the centuries andI now feel it best said through a film which I had not discussed at all, partly because I sharedthe general feeling that this was not one of Hitch’s most auspicious films. The acting wasuneven, the tone whimsical, the plot often cluttered and it suffered, or so I thought, fromthat general uncertainty of touch that sometimes characterised Hitchcock’s return toEngland. But then again his short wartime film Bon Voyage has beenunderestimated, as were in different ways Under Capricorn , the remade The ManWho Knew Too Much and later Frenzy . As Michael Walker has pointed out, Stage Fright has a structural complexity, a narrative coherence anda textual density missing from his 1930s films like Young And Innocent . In otherwords, it brings back to London in 1950 the innovating aspects of Hitchcock’s Hollywoodaesthetic of the 1940s. (shrink)

This paper works with the modern concept of the geological hotspot track – the building processes and movements of volcanic island chains – applied strategically to one of its illustrative formations, the Madeira Archipelago. By analogy, however, the concept works equally well to describe the important early 19th-century scientific knowledge-building activity that produced Charles Lyell's On the Geology of Some Parts of Madeira (1854). A central section of the paper uncovers the contributions to knowledge of this geology before Lyell's, and (...) in particular, Excursions of Madeira and Porto Santo (1825) by Mr [sic] T. Edward Bowdich. A thorough examination of this text then constitutes an important case study for literal and figurative investigation of geological hotspot tracks. The main argument proposed is that current specialist research forgets its submerged and longer histories to its detriment. Insights contained in older information often supply reminders of the key questions and contributions from the past that provide checks and balances for further developments of a field. By promoting multi-level, multi-stranded and multi-lingual investigation of the history of 19th-century geology in Madeira before Lyell (1854) as central to hotspot track research, this paper marks nodal conditions that constitute advancement in critical knowledge-building within and outside the discipline of geology. Some concerns raised by gender violence have been taken up by churches and individuals within them over the last ten years or so, but now the World Council of Churches has set up a project to work specifically on Overcoming Violence Against Women. The project has a three-fold task aimed at enabling constructive engagement with the issue of gender violence: to support and encourage the churches' to develop a network of concerned theologians; to establish an accessible resource base. The prevalence (...) of violence against women in all parts of society, including churches and Christian communities, raises theological questions. Some areas of language, doctrine and the interpretation of Scripture need to be examined and perhaps reconsidered, to provide theologies consistent with churches as communities of safety, respect and justice for women. Background The prioritization protocols for accessing adult critical care in the extreme pandemic context contain tiebreaker criteria to facilitate decision-making in the allocation of resources between patients with a similar survival prognosis. Besides being controversial, little is known about the public acceptability of these tiebreakers. In order to better understand the public opinion, Quebec and Ontario’s protocols were presented to the public in a democratic deliberation during the summer of 2022. Objectives (1) To explore the perspectives of Quebec and Ontario (...) citizens regarding tiebreakers, identifying the most acceptable ones and their underlying values. (2) To analyze these results considering other public consultations held during the pandemic on these criteria. Methods This was an exploratory qualitative study. The design involved an online democratic deliberation that took place over two days, simultaneously in Quebec and Ontario. Public participants were selected from a community sample which excluded healthcare workers. Participants were first presented the essential components of prioritization protocols and their related issues (training session day 1). They subsequently deliberated on the acceptability of these criteria (deliberation session day 2). The deliberation was then subject to thematic analysis. Results A total of 47 participants from the provinces of Quebec (n = 20) and Ontario (n = 27) took part in the online deliberation. A diverse audience participated excluding members of the healthcare workforce. Four themes were identified: (1) Priority to young patients - the life cycle - a preferred tiebreaker; (2) Randomization - a tiebreaker of last resort; (3) Multiplier effect of most exposed healthcare workers - a median acceptability tiebreaker, and (4) Social value – a less acceptable tiebreaker. Conclusion Life cycle was the preferred tiebreaker as this criterion respects intergenerational equity, which was considered relevant when allocating scarce resources to adult patients in a context of extreme pandemic. Priority to young patients is in line with other consultations conducted around the world. Additional studies are needed to further investigate the public acceptability of tiebreaker criteria. Originally published in 1963, The Concept of the Positron forms a detailed analysis of quantum theory. Whilst it is not as well known as Professor Hanson's previous book, Patterns of Discovery, the text has many interesting aspects. In many ways it goes further than Hanson's earlier work in approaching the problems of theory competition and the rationality of science, topics that have since become central to the philosophy of science. It is also notable for a rigorous and forthright defence of (...) the Copenhagen Interpretation. Taken together, the ideas presented in this book constitute a first-rate achievement in the history and philosophy of science. This paperback reissue comes with a new preface from Matthew Lund, Assistant Professor, Faculty of Philosophy and Religious Studies at Rowan University. (shrink)

Research on conspiracy theories has proliferated since 2016, in part due to the US election of President Trump, the COVID-19 pandemic, and increasingly threatening environmental conditions. In the rush to publication given these concerning social consequences, researchers have increasingly treated as definitive a 2016 paper by Michael Wood (Political Psychology, 37(5), 695–705, 2016) that concludes that the phrase “conspiracy theory” has no negative effect upon people’s willingness to endorse a claim. We revisit Wood’s findings and its (re)uptake in the recent (...) literature. Is the label “conspiracy theory” a pejorative? If so, does it sway or affect people’s belief in specific claims of conspiracy (i.e. particular conspiracy theories), or is the effect one that concerns claims of conspiracy more generally (i.e. all conspiracy theories)? Through an examination of the conceptual and methodological scope of Wood’s work and the results of our similar quasi-experimental design, we argue that it is premature to suggest the label “conspiracy theory” has no impact on the believability of a claim, or that it has no rhetorical power. Allen Orr wrote an extended critical review (over 6000 words) of my book No Free Lunch for the Boston Review this summer (http://bostonreview.mit.edu/BR27.3/orr.html). The Boston Review subsequently contacted me and asked for a 1000 word response. I wrote a response of that length focusing on what I took to be the fundamental flaw in Orr's review (and indeed in Darwinian thinking generally, namely, conflating the realistically possible with the merely conceivable). What I didn't know (though I should have expected it) (...) is that Orr would have the last word and that the Boston Review would give him 1000 words to reply to my response (see the exchange in the current issue at http://bostonreview.mit.edu/BR27.5/exchange.html). When Professor Orr published his hostile review of Darwin's Dangerous Idea in the biology journal, Evolution, last February, I was not pleased. His review was full of falsehoods and misconstruals, but I had no recourse; that journal, like most academic journals, does not permit authors to respond to reviews. Luckily for me, Orr has been so eager to warn the world of my errors that he has restated his attack, with embellishments, in the Boston Review, which has invited me to (...) respond.
